Nobody wants to become involved in a dispute but sometimes it cannot be avoided. Such disputes can lead to court proceedings being raised which can be stressful and worrying for all concerned. DWS can advise you on your options in order to try and resolve disputes at an early stage.

Whether you are being sued or are contemplating raising proceedings, we can advise you on the options available and deal with matters on your behalf. DWS always advises clients to take a “commercial view” when dealing with litigation. We recognise that in certain cases, litigation is neither required nor desired by our clients.

We deal with all aspects of civil court work in the Sheriff Courts and the Court of Session, acting on behalf of both Pursuers and Defenders. We specialise in a number of areas including commercial and contractual disputes, building and construction disputes, debt collection and insolvency proceedings.

Our Civil Litigation department is headed by William Summers, who has over 20 years of experience both in the Sheriff Court and Court of Session. He is a Solicitor Advocate with extended rights of audience in the Court of Session. This allows us to offer our clients the benefit of representation in the Court of Session when it is required.

DWS are also leading the way in the use of the new Commercial Court introduced at Aberdeen Sheriff Court in July 2004. The Commercial Court is designed to offer parties a “fast track” method of resolving commercial disputes. The benefit of using such a procedure is that it can lead to a quicker and more cost effective solution for our clients. We can advise on all aspects of the Commercial Court and its suitability for each particular case.

As well as providing advice on court proceedings, we also advise clients on other alternative means of dispute resolution, such as Mediation and Arbitration.
